Refund Policy

1. Introduction

This Refund Policy ("Policy") explains the circumstances in which payments made to Nitthish Finance ("Nithish Finance", "we", "us" or "our") may be refunded.

As Nitthish Finance provides financial and lending services, refunds relating to loan applications, processing charges, loan repayments, excess payments and other charges shall be governed by this Policy together with the applicable loan application, sanction letter, loan agreement, schedule of charges and other applicable documents.

Where applicable law or regulatory requirements provide a customer with a more favourable right, such requirements shall prevail.

2. Scope

This Policy applies to payments made by customers in connection with Nitthish Finance's services, including, where applicable:

  • Loan application-related payments
  • Processing fees
  • Documentation charges
  • Valuation charges
  • Legal charges
  • Other disclosed service charges
  • EMI payments
  • Advance payments
  • Duplicate payments
  • Excess payments
  • Other amounts received by Nitthish Finance

This Policy does not override the specific terms contained in an executed loan agreement.

3. Loan Application Fees and Processing Charges

Where a processing fee or application-related charge is applicable, the amount and refundability of the charge shall be communicated to the customer before the payment is made, as applicable.

A processing fee may be non-refundable where this has been clearly disclosed to the customer and is permitted under applicable law and the applicable loan terms.

Payment of a processing fee does not guarantee loan approval or disbursement.

If an application is rejected after credit, legal, technical or other assessment, the customer shall be entitled to any refund specifically provided for in the applicable terms.

4. Cancellation Before Loan Disbursement

A customer may request cancellation of a loan application before disbursement.

The treatment of amounts already paid shall depend on:

  • The nature of the payment
  • Whether the payment represents a service already provided
  • The applicable loan documents
  • Applicable laws and regulations
  • Any specific cancellation terms communicated to the customer

Any amount determined to be refundable shall be processed after verification.

5. Refund Where Loan Amount Is Not Disbursed

If Nitthish Finance receives a payment from a customer but the corresponding loan is not disbursed, Nitthish Finance shall review the payment and determine whether any amount is refundable in accordance with the applicable terms.

Where a payment is refundable, the refund shall normally be made to the original payment source or the customer's verified bank account, subject to applicable verification requirements.

6. Excess Payment

If a customer accidentally pays an amount greater than the amount due, the excess amount may be:

  1. Adjusted against the customer's outstanding dues, where permitted and agreed;
  2. Adjusted against a future repayment, where applicable; or
  3. Refunded to the customer after verification.

The customer may be required to provide appropriate bank account or payment information before an excess amount is refunded.

7. Duplicate Payment

If the same EMI, fee or other amount is accidentally paid more than once, the duplicate amount shall be verified.

Once confirmed, Nitthish Finance may:

  • Adjust the duplicate payment against outstanding dues;
  • Adjust it against a future payment; or
  • Refund the duplicate amount to the customer.

The customer should contact Nitthish Finance as soon as possible after identifying a duplicate payment.

8. Failed or Unsuccessful Transactions

If a customer's bank account or payment method is debited but Nitthish Finance does not successfully receive or record the payment, the transaction will be verified.

Where the amount is subsequently credited to Nitthish Finance and results in an excess or duplicate payment, the amount may be adjusted or refunded in accordance with this Policy.

Where the payment has failed and the amount has not been received by Nitthish Finance, the customer should contact their bank or payment service provider regarding the transaction.

9. EMI Payments

EMI payments made against an active loan are not treated as refundable purchases.

Once an EMI or repayment is successfully credited to the customer's loan account, it will normally be applied towards the customer's outstanding obligations in accordance with the applicable loan agreement and repayment schedule.

If an amount has been incorrectly collected or an excess payment has been identified, Nitthish Finance shall review the account and take appropriate action.

10. Prepayment and Foreclosure

Payment made by a customer for part-prepayment, foreclosure or closure of a loan is not considered a "refund".

Such payments shall be treated in accordance with the applicable loan agreement and the charges and conditions communicated to the customer.

Any eligible excess amount remaining after closure of the loan, subject to reconciliation, may be refunded to the customer.

11. Refund of Excess Amount After Loan Closure

After the loan is fully closed, Nitthish Finance may conduct an account reconciliation.

If any amount is found to be payable to the customer, such amount may be refunded after verification of:

  • Customer identity
  • Loan account
  • Payment records
  • Outstanding balance
  • Applicable charges
  • Bank account details

12. Payment Made to an Incorrect Account

If a customer transfers money to an incorrect bank account or payment destination that is not controlled by Nitthish Finance, the customer should immediately contact their bank/payment service provider.

Nitthish Finance shall not be responsible for payments made to unauthorised accounts or payment links not issued or approved by Nitthish Finance.

Customers should use only official payment channels communicated by Nitthish Finance.

13. Unauthorised Transactions

If a customer believes that an unauthorised payment has been made from their account, the customer should immediately:

  1. Contact their bank/payment service provider;
  2. Inform Nitthish Finance;
  3. Provide the transaction reference number;
  4. Provide supporting documentation requested for investigation.

Nitthish Finance shall review the transaction and take appropriate action based on the investigation and applicable law.

14. Refund Processing Time

Where a refund is approved, Nitthish Finance will initiate the refund within a reasonable period after completion of the necessary verification and reconciliation.

The actual time taken for the amount to appear in the customer's bank account may depend on:

  • Bank processing times
  • Payment gateway processing
  • Payment network
  • Transaction type
  • Public holidays
  • Technical issues
  • Other third-party payment service providers

Nitthish Finance shall not be responsible for delays caused solely by a customer's bank or third-party payment provider.

15. Refund Method

Where possible, refunds shall be made through the original payment method.

Where refund through the original payment method is not possible, Nitthish Finance may request verified bank account details from the customer.

Nitthish Finance may require additional verification before processing a refund to prevent fraud or unauthorised claims.

16. Documentation Required for Refund

Depending on the nature of the refund, Nitthish Finance may request:

  • Customer name
  • Loan account/application number
  • Transaction reference number
  • Payment receipt
  • Bank statement or transaction confirmation
  • Identity verification
  • Bank account details
  • Other information reasonably required to verify the claim

17. Non-Refundable Charges

Certain charges may not be refundable where they represent services already provided or expenses already incurred, provided that such charges have been properly disclosed and are permitted under applicable law.

Examples may include, where applicable:

  • Processing charges
  • Legal verification charges
  • Property valuation charges
  • Vehicle valuation charges
  • Documentation charges
  • Statutory/government charges
  • Other third-party expenses

The exact treatment of each charge shall be specified in the applicable loan documents or schedule of charges.

18. No Automatic Refund on Loan Rejection

Rejection of a loan application does not automatically mean that every amount paid by the applicant will be refunded.

Refundability shall depend on the nature of the payment, the terms communicated to the customer and applicable law.

Any amount that is refundable shall be processed after the required verification.

19. Fraudulent or Incorrect Claims

Nithish Finance reserves the right to investigate refund claims.

Where there is evidence of:

  • Fraud
  • Misrepresentation
  • Forged documents
  • Manipulation of transaction records
  • Unauthorised access
  • False refund claims

Nithish Finance may reject the claim and take appropriate action permitted by law.

20. Refunds and Loan Outstanding

A refund shall not automatically reduce or cancel a customer's loan obligation unless the amount has been formally credited or adjusted against the relevant loan account.

Customers must continue to make scheduled repayments until they receive confirmation that an amount has been appropriately adjusted or the loan has been closed.

21. Customer Responsibility

Customers are responsible for:

  • Providing accurate payment information
  • Using official Nithish Finance payment channels
  • Keeping payment receipts
  • Reporting duplicate or incorrect payments promptly
  • Providing accurate bank account details for refunds
  • Informing Nithish Finance of unauthorised transactions as soon as reasonably possible

Nithish Finance shall not be responsible for losses caused by incorrect information provided by the customer.

22. Changes to this Refund Policy

Nithish Finance may modify this Refund Policy from time to time to reflect changes in:

  • Products and services
  • Payment methods
  • Business practices
  • Technology
  • Applicable laws
  • Regulatory requirements

The updated Policy will be published on the Nithish Finance website or application where appropriate.

Changes shall not affect rights that have already accrued to a customer under applicable law or an existing contractual agreement.

This Refund Policy is a general policy applicable to Nitthish Finance's services.

The refundability of a particular payment shall be determined by:
